Welcome to RadioShankill.co.uk (“we”, “us”, “our”, or “RadioShankill”). These Terms of Service (“Terms”) govern your access to and use of our website, services, and platform (the “Service”)

By using or accessing the Service, you agree to be bound by these Terms, our Privacy Policy, and any other policy we post on the site.

 

1. Definitions

  • User: Any person who visits, browses, or uses RadioShankill, including both creators and consumers.

  • Creator: A User who registers an account to upload content and optionally charge subscribers.

  • Subscriber / Fan: A User who subscribes to or pays for a Creator’s content.

  • Subscription: A recurring monthly fee paid by a Subscriber to a Creator.

  • Tip / One-off Payment: Non-recurring payments from a Subscriber to a Creator.

  • Pay‑Per‑View (PPV): Content that a Subscriber pays to unlock on a per-item basis.

  • Platform Fee: The commission we take on Creator earnings.

  • Balance: The amount of money due to a Creator after fees, pending withdrawal.

  • Withdrawal: The process by which a Creator transfers their Balance out of the platform.

  • Age Verification: A process to confirm a user’s age

  • Verification: Verification of creators’ identity (e.g. via ID/passport)

 

2. Acceptance of Terms

  1. By registering for an account (as a Creator or Subscriber) or using the platform, you accept these Terms.

  2. If you do not agree to these Terms, do not use or access the Service.

  3. We may modify these Terms at any time. When we do, we will post the new Terms on our website with an updated “Last Updated” date. Your continued use constitutes acceptance.

 

3. Eligibility & Registration

  1. Age: You must be at least 18 years old (or the legal age in your jurisdiction) to create content, receive payments, or subscribe.

  2. Account Creation: To become a Creator or Subscriber, you must register for an account, provide accurate information, and keep your account details up to date.

  3. Verification: We may require Creators to verify their identity by submitting a photo of their ID/passport or other documentation.

  4. Age Verification: For certain types of content, or if enabled by us, you may need to complete an age verification process.

 

4. Creator Content & Conduct

  1. Content Ownership: Creators retain ownership of the content they upload.

  2. License to Platform: By uploading, you grant RadioShankill a non-exclusive, worldwide, royalty-free licence to host, stream, display, and distribute your content to your subscribers (and other permitted users) via the Service.

  3. Content Guidelines: You agree not to upload or share content that:

    • Violates any law or regulation;

    • Is defamatory, obscene, or harmful;

    • Infringes third-party IP rights;

    • Contains spam, viruses, or malicious code.

  4. Live Streaming / Messaging: If you use live streaming, messages, or other interactive features, you must abide by respectful conduct. Harassment, hate speech, or illegal content are prohibited.

  5. Age-restricted Content: For content that requires age restriction, you must comply with laws, and we may enforce age verification for access.

  6. Moderation / Removal: We reserve the right to remove or disable access to any content that violates these Terms or our policies, with or without notice.

 

5. Monetization, Payments & Fees

  1. Subscriptions:

    • Creators can set a monthly subscription price for their content.

    • Subscribers pay via our integrated payment gateways (e.g., Stripe).

  2. Tips / One-off Payments: Subscribers may send one-time payments or “tips” to Creators.

  3. Pay‑Per‑View (PPV): Creators may designate some posts or content as PPV, requiring a separate payment to unlock.

  4. Platform Fee: RadioShankill charges a 10% commission on Creator revenues (subscriptions, tips, PPV).

  5. Payouts / Withdrawals:

    • Creators can withdraw their Balance.

    • Withdrawal terms, minimums, schedule, and method depend on the settings in our admin system.

    • We reserve the right to verify identity before processing withdrawals (e.g., via KYC).

  6. Refunds / Cancellations:

    • Subscribers may cancel their subscriptions at any time; cancellation applies to the next billing cycle unless otherwise stated.

    • Refund policy: [Define your refund policy here — e.g., “no refunds after payment unless required by law” or “partial refunds for PPV content within 24 hours”].

  7. Taxes: Creators are responsible for any taxes (income tax, VAT, etc.) on their earnings. RadioShankill does not withhold tax unless required by law.

  8. Payment Processing Fees: Payment gateway fees (e.g., Stripe) are borne by either the Creator, the Subscriber, or split

 

6. Advertisements

  1. Ad Inventory: RadioShankill may run advertisements on the platform (homepage, creator pages, feed, etc.).

  2. Revenue from Ads:

    • Ad revenue is not shared with Creators unless explicitly agreed in writing.

    • You acknowledge that by using the Service, you consent to ads being displayed to users.

  3. Sponsored Content / Partnerships: If Creators engage in promotional content or partnerships, those are separate from regular subscription revenue, unless otherwise agreed.

 

7. Age and Verification Controls

  1. Age Verification Enforcement: For users who want to access age-restricted content, we may require Yoti (or another third-party) age verification.

  2. Re-verification: We may ask users to re-verify if suspicious activity arises or at regular intervals.

  3. Account Suspension or Termination: Accounts failing verification, providing false information, or violating content/behaviour rules may be suspended or terminated.

 

8. User Conduct & Prohibited Use

  1. General Conduct: Users must behave respectfully. Harassment, hate speech, threats, and similar behavior are prohibited.

  2. Prohibited Uses: Users may not:

    • Use the Service for illegal activities;

    • Impersonate other users;

    • Upload malicious code (viruses, malware);

    • Spam, scam, or harass others;

    • Circumvent payment (“chargeback fraud” etc.).

  3. Reporting & Enforcement:

    • Users can report content or other users.

    • We may investigate and take action, including removal of content, warnings, suspensions, or permanent bans.

    • In severe cases, we may cooperate with law enforcement or third parties.

 

9. Intellectual Property

  1. Creator IP: As above, Creators own their content but grant a licence to RadioShankill for hosting and distribution via the Service.

  2. Platform IP: All trademarks, logos, code, designs, and other IP on RadioShankill are owned by us (or licensed to us).

  3. User-Submitted Feedback: If you submit feedback (bugs, suggestions, improvements), you grant us a worldwide, non‑exclusive, royalty-free licence to use such feedback.

 

10. Privacy & Data Protection

  1. Privacy Policy: Our Privacy Policy describes how we collect, use, store, and share your personal data. By using the Service, you agree to that Policy.

  2. Data Storage: We store content (e.g., videos, files) using the storage systems supported by our network (e.g., Amazon S3, Backblaze, Vultr, or local storage)

  3. Verification Data: Identity / age verification data (IDs, passports) may be securely stored for verification and compliance purposes.

  4. Third-Party Services: We use third-party services (payment processors, age-verification providers, etc.) — those services may also collect or process data under their own privacy terms.

 

11. Disclaimers & Limitations of Liability

  1. No Guarantee: We make no guarantees about the availability of the Service, quality of Creators’ content, or earnings.

  2. Warranties: The Service is provided “as is” and “as available,” to the fullest extent permitted by law.

  3. Limitation of Liability: To the maximum extent permitted by law, RadioShankill.co.uk, its owners, affiliates, and service providers shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of revenue, income, data, or use, arising from or relating to your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages.

    You acknowledge and agree that your use of the Service is at your own risk, and all content and services are provided “as is” and “as available.”

  4. Indirect Damages: We are not liable for indirect, incidental, special, punitive, or consequential damages.

 

12. Termination & Suspension

  1. By You: You may deactivate your account at any time (for both Creators and Subscribers). Deactivation does not necessarily delete your content; see our deletion policy.

  2. By Us: We may suspend or terminate your account (with or without notice) for:

    • Breach of these Terms

    • Illegal or prohibited activity

    • Non-verification or fraudulent behavior

  3. Effect on Funds: On termination, Creators may be paid their remaining Balance (subject to verification and pending withdrawal policy). We reserve the right to withhold payment if there is a dispute.

  4. Data Retention: After termination, we may retain certain data (e.g., transaction history, content) in accordance with our Privacy Policy and legal obligations.

 

13. Dispute Resolution

  1. Governing Law: These Terms are governed by the laws of Northern Ireland.

  2. Jurisdiction: Any dispute arising from or in connection with these Terms will be resolved in the courts of United Kingdom, unless otherwise agreed.

  3. Informal Resolution: Before taking formal legal action, both parties agree to attempt to resolve disputes informally by emailing [[email protected]].

  4. Arbitration / Mediation: We may require mediation or arbitration for certain categories of disputes.

 

14. Miscellaneous

  1. Entire Agreement: These Terms plus our Privacy Policy and any other posted policies constitute the entire agreement between you and RadioShankill.

  2. Severability: If any provision is invalid or unenforceable, the rest of the Terms remain in effect.

  3. Waiver: Our failure to enforce any right or provision under these Terms is not a waiver of future enforcement.

  4. Assignment: We may assign or transfer our rights and obligations under these Terms (e.g., to a successor). You may not assign your rights without our prior written consent.

  5. Notices: We may send notices (changes, policy updates) via email to your registered address or by posting on the Service.
